These Terms of Service apply to the website fawnelle.com and all related storefronts, checkout pages, emails and customer-service channels (together, the “Site”) operated by WILOECOM LLC, a Wyoming limited liability company doing business as “Fawnelle” (“Fawnelle”, “we”, “us”, “our”). Please read these Terms of Service (“Terms”) carefully before using the Site or purchasing any product. By accessing the Site, placing an order or starting a subscription, you agree to be bound by these Terms, our Privacy Policy, Shipping Policy, Refund Policy and Subscription Policy, which are incorporated by reference. If you do not agree, do not use the Site.
1. Eligibility
You must be at least 18 years old and able to enter into a binding contract to use the Site or purchase our products. By ordering, you confirm that you meet these requirements and that the information you provide is accurate and complete.
2. Our products and important health disclaimer
Fawnelle products are dietary supplements. These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease. Results vary from person to person and depend on many factors including diet, activity, health status and consistency of use. Testimonials and before/after stories on the Site reflect individual experiences and are not a guarantee of results.
Nothing on the Site is medical advice. Always read the label and follow the directions for use. Do not exceed the recommended dose. Consult your physician or a qualified healthcare professional before use if you are pregnant, breastfeeding, trying to conceive, under 18, taking any medication (including thyroid, blood-thinning, blood-pressure or hormonal medication), have a medical condition, or are scheduled for surgery. Discontinue use and consult a doctor if you experience any adverse reaction. Keep out of reach of children. Store in a cool, dry place.
Our products contain ingredients derived from deer (cervid) and bovine organs and botanical extracts. Check the full ingredient list before purchasing if you have allergies or dietary restrictions.
3. Orders, pricing and payment
- All prices are shown in the currency selected for your region and include applicable product taxes unless stated otherwise at checkout. Shipping is free on every order to the countries we serve; any exception will be displayed before you pay.
- Your order is an offer to buy. We accept it when we send the shipping confirmation. We may refuse or cancel any order — for example, for suspected fraud, pricing or stock errors, resale, or violation of these Terms — and will refund any amount charged.
- We accept major credit and debit cards, Shop Pay, Apple Pay, Google Pay and PayPal. By providing a payment method you confirm you are authorised to use it and authorise us (and our payment processors) to charge the total shown at checkout, and for subscriptions, each recurring amount described in the Subscription Policy.
- Promotional prices, countdown timers, bundle discounts and “compare at” prices reflect our current promotion and may change without notice. Discounts cannot be combined unless stated. A discount code must be applied at checkout; we cannot apply it retroactively.
- Obvious pricing errors are not binding. If we discover an error after you order, we will contact you to reconfirm at the correct price or cancel and refund.
- Multi-currency pricing is converted and rounded by Shopify Markets. Your bank may apply its own conversion fees; these are outside our control.
4. Subscriptions (Subscribe & Save)
When you choose a subscription, you authorise recurring charges at the interval and price displayed at checkout until you cancel. Full details — including how to pause, skip, edit or cancel, renewal reminders and refunds — are in our Subscription Policy, which forms part of these Terms.
5. Shipping and risk of loss
Shipping times, tracking, customs and lost-parcel handling are described in our Shipping Policy. Risk of loss and title pass to you on delivery to the address you provided. You are responsible for providing a complete and accurate delivery address.
6. 60-Day Money-Back Guarantee and refunds
We stand behind our products with a 60-Day Money-Back Guarantee on your first order, even if you have opened and used a jar. The conditions, exclusions and process are set out in our Refund Policy, which forms part of these Terms.
7. Accounts and customer portal
You are responsible for keeping your login details confidential and for all activity under your account. Notify us immediately of any unauthorised use. We may suspend or close accounts that violate these Terms.
8. Acceptable use
You agree not to: use the Site for any unlawful purpose; resell our products without written permission; scrape, copy or reverse-engineer the Site; upload malicious code; impersonate any person; interfere with the Site’s security; post reviews that are false, misleading or not based on genuine use; or make chargebacks in bad faith instead of using our refund process. We may restrict access for violations.
9. Reviews, testimonials and user content
By submitting a review, photo, video, testimonial or other content, you grant us a worldwide, royalty-free, perpetual, irrevocable, sublicensable licence to use, reproduce, edit, publish and display it in any media, including advertising, with or without your first name and initial. You confirm the content is your own, truthful, reflects your genuine experience, and does not infringe anyone’s rights. We may remove content at our discretion and may moderate reviews for spam, profanity or medical claims.
10. Intellectual property
The Site, the Fawnelle name and logo, the deer-and-sun emblem, product formulas, packaging, images, text, graphics, videos and software are owned by or licensed to WILOECOM LLC and protected by trademark, copyright and other laws. You may not use them without our prior written consent, except to view the Site for personal shopping.
11. Third-party services
Payment, shipping, subscription management, reviews and social features are provided by third parties under their own terms. We are not responsible for their acts or omissions beyond what the law requires.
12. Disclaimer of warranties
EXCEPT FOR THE 60-DAY MONEY-BACK GUARANTEE AND ANY WARRANTY THAT CANNOT BE EXCLUDED BY LAW, THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY PARTICULAR RESULT WILL BE ACHIEVED FROM USING OUR PRODUCTS.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WILOECOM LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AGENTS AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA OR GOODWILL, ARISING OUT OF OR RELATING TO THE SITE, THESE TERMS OR ANY PRODUCT. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS; IN THAT CASE THEY APPLY TO THE MAXIMUM EXTENT PERMITTED. NOTHING IN THESE TERMS LIMITS LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, FRAUD, OR ANY LIABILITY THAT CANNOT BE LIMITED BY LAW, INCLUDING YOUR STATUTORY CONSUMER RIGHTS IN THE UK, EU, CANADA AND AUSTRALIA.
14. Indemnification
You agree to indemnify and hold harmless WILOECOM LLC and its affiliates from any claim, loss or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Site or products, or content you submit.
15. Dispute resolution, arbitration and class-action waiver
Informal resolution first. If you have a dispute, email support@fawnelle.com with “Dispute” in the subject. We will try to resolve it within 30 days.
Binding arbitration (U.S. customers). If we cannot resolve the dispute informally, you and we agree that any dispute arising out of or relating to these Terms, the Site or our products will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court. The Federal Arbitration Act governs this clause. The arbitration will take place by video, phone or written submissions, or in the county where you live. We will pay AAA filing and arbitrator fees for claims under $10,000 unless the arbitrator finds the claim frivolous.
Class-action waiver. YOU AND WE AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, CONSOLIDATED OR REPRESENTATIVE PROCEEDING.
30-day opt-out. You may opt out of this arbitration agreement by emailing support@fawnelle.com within 30 days of your first purchase, stating your name, order number and that you opt out of arbitration.
Customers outside the U.S. Nothing in this section deprives you of the protection of mandatory consumer laws or the courts of your country of residence where those laws apply.
16. Governing law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules, and subject to the mandatory consumer laws of your country of residence. Subject to Section 15, the state and federal courts located in Wyoming have exclusive jurisdiction.
17. Changes, severability and entire agreement
We may update these Terms at any time by posting the revised version with a new effective date. Changes apply to orders placed after posting. If any provision is held invalid, the remainder remains in effect. These Terms and the policies incorporated by reference are the entire agreement between you and us regarding the Site and our products. Our failure to enforce any provision is not a waiver.
